INTRODUCTION

This Privacy Policy is introduced and implemented by  M Cha Bar” (the “We”, or “Corporation”), for (i) the operation of “M Cha Bar” stores directly owned and operated by us (the “Stores”) or (ii) our use of any website, mobile application or other digital or online service or platform to operate the M Cha Bar business, whether directly owned and operated by us or by any of our franchisees (the “Franchisees”), with the purpose of protecting your privacy. It sets out the privacy practices that apply when you visit the Stores, use any mobile application or digital platform operated by us, or engage with us through any interaction, including via third-party platforms such as social media. For clarity, this Privacy Policy does not apply to the privacy practices of any of the Franchisees operating under the same brand. Each of them is independently responsible for their own privacy practices.

This policy describes how we collect, use, disclose, and protect your personal information, describes the types of information we may collect from you or that you may provide, and our practices for collecting, using, maintaining, protecting, and disclosing that information.

We will only use your personal information in accordance with this policy unless otherwise required by applicable law. We take steps to ensure that the personal information that we collect about you is adequate, relevant, not excessive, and used for limited purposes.

Privacy laws in Canada generally define “personal information” as any information about an identifiable individual, which includes information that can be used on its own or with other information to identify, contact, or locate a single person. Personal information does not include business contact information, including your name, title, or business contact information.

  • When you use our Wi-Fi offered at the Stores.

  • When you visit our website or any third-party website, or use any mobile application operated by us or any third party for online ordering.

  • When you participate in any reward program offered by us.

  • When you create an account with us, whether by visiting the Stores or through any online system.

  • When you sign up with us to receive marketing emails, such as newsletters, offers and promotions.

  • When you enter a contest or participate in an event or promotion initiated or sponsored by us.

  • When you donate to one of our fundraising or community initiatives.

  • When you interact with us via email, text, social media and other electronic messages between you and us.

  • When you apply for a job with us.

INFORMATION WE COLLECT ABOUT YOU

1.    We may collect the following information from you when you visit our Stores or purchase our products or services:

•    Your contact information – such as your phone number, email address, or other contact details you provide when placing an order, making an enquiry, or signing up for promotions.
•    Your name – when provided in connection with a purchase, reservation, or customer inquiry.
•    Your payment information – such as credit or debit card details, WeChat Pay, Ali Pay, Apple Pay or other transaction data necessary to process your payment.
•    Your video or sound – our Stores may be equipped with a surveillance system that may capture images or audio recordings of you for security and safety purposes.
•    Information about you and your device when you access our Wi-Fi – including your device ID, IP address, browser type, operating system, and other technical details that help us maintain and improve our network.

2.    When you order food online, whether through our website or mobile app, or via a third-party platform (such as Uber Eats, DoorDash, SkipTheDishes, Fantuan, or other food delivery services), we may collect:

•    Your full name.
•    Contact information, including phone number and email address.
•    Delivery address and billing address.
•    Order details, including items purchased, special instructions, dietary preferences, and time of order.
•    Payment information, such as credit/debit card number (processed through a secure third-party payment gateway), billing name, and billing postal code.
•    Transaction and purchase history.
•    Device information (if ordering through our platform), including IP address, browser type, operating system, and other technical identifiers.
•    Referral information, such as how you found our site or app (e.g., through a search engine or referral link).
•    Feedback or ratings you provide regarding the order or experience.

3.    When you participate in a reward program or sign up for an account with us, either online or in-store, we may collect:

•    Full name, email address, phone number, and mailing address.
•    Date of birth, if required for eligibility (e.g., age-based rewards or promotions).
•    Account login credentials, including username and password.
•    Preferences and interests you voluntarily provide.
•    Membership status and activity, including points collected, redemptions, and program tier level.

4.    When you enter a contest or promotion, or participate in a fundraising or community campaign organized or sponsored by us, we may collect:

•    Content you submit, including essays, photos, videos, social media tags, or responses.
•    Information related to prize delivery, including government-issued ID for verification, if applicable.
•    Donation details, if applicable to fundraising (such as amount donated, payment method, and charitable receipt preference).

5.    When you interact with us via social media platforms, such as Instagram, Facebook, TikTok, or others, we may collect:

•    Your social media handle, profile photo, and any publicly accessible profile details.
•    Comments, direct messages, posts, or mentions that tag us or include our brand name.
•    Content you submit or share, such as photos or videos in response to our campaigns or promotions.
•    Engagement data, such as likes, shares, or reposts.
•    User-generated content if you consent to us reposting or using it.
•    Location information, if your post includes geotags or if provided via the platform.
Note: We will only access or collect information you have made publicly available or have explicitly shared with us in accordance with the social media platform's terms and your privacy settings.

6.    When you apply for a job with us, either in person or online, we may collect:

•    Your resume/CV, including full name, contact information, education history, and work experience.
•    Cover letter or application form responses, including your interest in the role and availability.
•    References and referees' contact information, where provided.
•    Interview notes, assessment results, and other recruitment records.
•    Government-issued ID or documentation verifying your identity and legal right to work (e.g., SIN, work permit, or visa status).
•    Criminal background check information, if required for the role and permitted by law.
•    Any correspondence or communication exchanged during the hiring process.
 

HOW WE USE YOUR INFORMATION

If you enter a contest, promotion, or participate in a fundraising or community campaign, we use your information to manage your participation, verify eligibility, administer prizes or donations, and communicate relevant updates. When you interact with us on social media, we may use publicly shared content or direct communications to respond to your inquiries, engage with you, repost user-generated content (with consent), and improve our brand presence and customer engagement. If you apply for a job with us, we use your application information to assess your qualifications, conduct interviews and reference checks, verify your identity and work eligibility, and manage the hiring process. Additionally, we may use information collected via our surveillance system and Wi-Fi network to ensure the safety and security of our premises, protect against fraud or unauthorized access, and maintain the integrity of our operations.
 

From time to time, we may offer you the opportunity to participate in customer surveys to help us improve our products, services, and overall customer experience. Participation in these surveys is entirely voluntary. Any information you provide in response to a survey will be used in an aggregated and de-identified form, meaning it will not be linked to you personally and cannot be used to identify you.   • To the Franchisees, with whom we work closely to deliver products and services under the brand’s overall management and operational system, including fulfilling orders, addressing customer inquiries, providing support, or jointly conducting marketing, promotional, or community campaigns. This sharing helps ensure a consistent and coordinated experience across locations operating under our brand. Please note that each Franchisee is independently owned and operated and maintains its own privacy practices. Any personal information collected or handled directly by a Franchisee is governed by that Franchisee’s own privacy policy.

  • To service providers or business partners,  who support our business operations and help us deliver products and services to you. These may include but are not limited to software providers who maintain our online ordering system, website, or mobile app; food delivery service providers; advertising and marketing agencies; data analytics companies; and payment processing providers. The information shared with these service providers may include your name, contact details, order and transaction information, payment information and technical data related to your use of our platforms. We share this information solely for the purpose of enabling these providers to perform services on our behalf and in connection with our business operations. We do not authorize them to use or disclose your information for their own marketing purposes or for any purposes unrelated to the services they are providing to us.

  • To parties in connection with donations and fundraising initiatives that we participate or sponsor, who we may share your information with when you choose to donate or participate in one of their initiatives.

  • In accordance with applicable law, to a successor in the event of an amalgamation, divestiture, restructuring, reorganization, dissolution.

  • To fulfill the purpose for which you provide it.
